CBD in France: What the New Senate Bill Would Change for Shops, Traceability and Driving

On 8 October 2026, seventeen French senators from the Green group, led by Guillaume Gontard, filed a bill in the Senate to regulate the production, traceability and sale of CBD products in France. If you buy from Odile.green in France or are curious how this could affect online shops like ours, here is what the bill actually contains. It has not been debated or voted on yet.
A six-article bill, filed in the Senate
Bill n°21 (2026-2027 session) was registered with the Senate on 8 October 2026. It has six articles amending the Public Health Code, the General Tax Code and the Road Traffic Code. No debate date has been set yet: a French Senate bill can be amended, delayed, or never scheduled for a vote at all.
Traceability: a government hemp register
The bill creates an automated data system the senators call the "casier chanvrier informatisé" (computerised hemp register). Every production batch would get an ID number tracked from farming or import through to the final sale. Importers would have to keep origin documents for five years.
Shops: advance declaration and an operating permit
Opening or moving a CBD shop would require a declaration to local authorities fifteen days in advance. Shop operators would also need an operating permit, issued after training on regulations, protecting minors, traceability and their own legal responsibilities. Sales to under-18s would be banned, warning labels would become mandatory, and vending machines would be restricted unless they check the buyer's age.
Whether you shop in person or order online, our CBD buying guide covers what to check on a product before you buy.
Driving: a 2 ng/mL blood-THC threshold
The bill sets a threshold of 2 nanograms of THC per millilitre of blood, below which driving would no longer count as an offence. The stated aim is to separate trace THC left by a compliant CBD product (under the 0.3% THC limit already set by EU law) from actual cannabis use. This threshold is only a proposal for now: it has no legal force unless the Senate votes it through.
What stays the same, for now
The 0.3% THC limit that defines legal CBD in France and across the EU is not touched by this bill. The proposal deals with traceability, retail sales and driving; it does not change hemp farming rules or the list of allowed products. We will update this article if the Senate schedules a debate.
Frequently asked questions
Is CBD already legal in France?
Yes: selling CBD products is allowed as long as their THC content stays under 0.3%, under current EU rules. This bill does not change that threshold.
Is this law already in force?
No. The bill was only filed in the Senate on 8 October 2026; it has not been reviewed in committee or voted on.
What is the "casier chanvrier informatisé"?
It's the name the bill gives to the database that would track each CBD batch, from production or import through to the sale to the end customer.
